An Uncontested Divorce in Texas is a divorce that is not challenged.

Below are the types of Divorces that are considered Uncontested

Agreed Texas Divorce If both spouses have agreed to divorce and to the terms of their divorce, one spouse files the divorce papers at the courthouse and then gives the other spouse a copy. The spouse who will not be filing the divorce papers only needs to sign a document (in which you will be provided with) acknowledging his/her agreement to divorce and request not to be served and the divorce proceedings can go on without him/her having to do anything else.

Missing Spouse Divorce In Texas If you are unable to locate your spouse and have tried your best to find him/her, you can still get your divorce. You can notify your spouse one of the following two ways:

1. If there are no children involved in your marriage, you will have to place a notice in the courthouse.

2. If there are children and/or you and your spouse own any property together in the marriage you will have to run an ad in the local newspaper in the city in which your Spouse last resided.

If your spouse is MISSING you will need to enter his/her last known mailing address (if you know it). You will also need to include the last place (City and State) you and your spouse resided together when filling out the Information Form.

That spouse notifies the other spouse by serving them with divorce papers by a constable, sheriff or any other authorized process server. The spouse who is served with the divorce papers is not required to sign anything. As long as they have been notified, their consent for the divorce is not required. This is usually done when one spouse refuses to sign divorce papers, but will not contest the divorce.
